The Pendleton Circuit Court Grand Jury indicted Justin Wayne Nueby of eight counts of Possession of Matter Portraying Sexual Performance by a Minor and one count of Tampering with Physical Evidence.
The Grand Jury bill reads that Nueby possessed photos of a young female in sexual positions and performing a sexual act.
Count 9 charges that the former Northern Pendleton fire chief believed that “an official proceeding might be instituted, he destroyed, mutilated, concealed, removed or altered physical evidence, believing that said physical evidence would be used in an official proceeding and with the intent to impair its verity or availability in the official proceeding.”
The grand jury set bail for Nueby at $25,000 with the conditions that he not go upon the property of any school, not have contact with any minors, be on monitored conditional release under the supervision of pretrial services, not possess or consume any alcohol or controlled substances, make all court appearances and not commit any further offenses.
He is scheduled to make his next court appearance on June 16.
